1. Who We Are
Paymenty BV is a company registered in Belgium that provides a payment platform built on regulated payment infrastructure. Card processing and regulated payment services are delivered through our regulated payment partner; Paymenty acts as data controller for the personal data processed in connection with our platform services.
2. What Data We Collect
We collect: account data (name, role, contact details), transaction data (payment amount, currency, timestamps, payer details), KYC/KYB documents (identity documents, registration certificates, beneficial ownership), and device/usage data (IP address, device identifiers, log files).
3. How We Use Your Data
We use your personal data to process payments, comply with legal and regulatory obligations (KYC, AML, sanctions screening), prevent and detect fraud, provide customer support, send transactional and service communications, and improve our services.
4. Legal Basis for Processing
We process personal data on the basis of contract performance, compliance with legal obligations (including AML, PSD2, and tax regulations), our legitimate interests in operating and securing our services, and your consent for optional communications.
5. Data Sharing
We share data only with payment networks (e.g. card schemes, banks), KYC and identity verification providers, regulatory and law enforcement authorities where required, and trusted infrastructure providers under strict confidentiality agreements. We do not sell customer data to third parties.
6. Data Retention
Transaction records and KYC documents are retained for at least 7 years from account closure to comply with AML obligations. Account data is retained for the duration of your contract plus 2 years. We delete or anonymise data once retention obligations end.
7. Your Rights
Subject to applicable law, you have the right to access, rectify, erase, port, or restrict processing of your personal data, to object to processing based on legitimate interests, and to lodge a complaint with your local data protection authority.
8. International Transfers
Your personal data is processed and stored within the European Union. Where any transfer outside the EU/EEA is necessary, we rely on Standard Contractual Clauses or other lawful safeguards.
9. Cookies
We use essential cookies required for service operation, functional cookies that remember preferences, and privacy-respecting analytics cookies. We do not use advertising cookies. You can manage cookie preferences from your browser settings.
